Right of Withdrawal from the Agreement

If you are a so-called Privileged Buyer (Kupujący uprzywilejowany), meaning:

A) A Consumer, or

B) A natural person for whom the agreement you concluded with us is directly related to your business activity, but does not possess a professional character for you.

As a rule, you have the right to withdraw from the distance agreement concluded.

  • You can withdraw from the agreement by submitting a statement of withdrawal to us, for example, via an email message sent to: sklep@ts-parts.eu.

  • You can withdraw from the agreement within 14 days.

  • The 14-day period for withdrawal from the agreement begins upon you or a third party indicated by you, other than the carrier, taking possession of the goods. In the case of an agreement covering multiple goods delivered separately, in lots, or in parts, the period starts from the taking possession of the last item, lot, or part.

  • Sending the statement before the deadline expires is sufficient to meet the deadline.

  • You must return the goods to us immediately, to the address: ul. Golędzinowska 33a, 03-302 Warszawa, Polska, but no later than 14 days from the day you withdrew from the agreement.

  • We will immediately reimburse the payments you made for the product, based on the rules indicated in the Store's Terms and Conditions, but no later than 14 days from the day we receive your statement of withdrawal. We do not reimburse the cost of shipping. Please send back the product along with all its accessories and a copy of the purchase invoice or the order number.

  • We may withhold reimbursement of the payment received from you until we have received the goods back or you have supplied evidence of having sent them back, whichever event occurs first.

Please remember that the right of withdrawal from a distance agreement does not apply to you in relation to, among others, an agreement:

  • in which the subject of the service is a non-prefabricated item, manufactured according to your specifications or serving to satisfy your individualized needs;

  • in which the subject of the service is an item liable to deteriorate rapidly or with a short expiry date;

  • in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;

  • in which the subject of the service is a sound or visual recording or a computer program delivered in a sealed package, if the package was opened after delivery.

Complaints

The following content applies to the Privileged Buyer. If you are not one, please refer to our Store's Terms and Conditions for detailed information on complaints.

  • In the event that we improperly fulfill the agreement concluded with you, you have the right to lodge a complaint – preferably via email to: sklep@ts-parts.eu or by post to the address ul. Stanisława Rogalskiego 2/90, 03-982 Warszawa.

  • As a rule, we are responsible for the non-conformity of the goods with the agreement, existing at the time of its delivery and disclosed within two years from that time.

  • Based on the provisions of the Consumer Rights Act, in such a situation, you may demand: a) Exchange of the goods or b) Repair of the goods.

  • In some cases, you may also: a) Withdraw from the agreement or b) Submit a declaration of price reduction – you can find details on this matter in our Store's Terms and Conditions.
